Legal advice can only be provided by a licensed attorney within the State. All non-attorney staff members of our office are prohibited from providing legal advice.

Attorney Representation

Attorney Representation

Legal Advice is Not Provided by any Non-Lawyer

Attorney Representation is not and cannot be provided directly from our office; however, for individuals who either feel uncomfortable with public speaking in front of a Judge, or those who desire to even the playing field, we can provide contact information to a local attorney licensed with the State Bar of California, that is in good standing or we can provide you with a local bar association that generally has a lawyer referral service so that they can further assist you if you do not already have legal representation.

We do not receive any means of compensation or referral fee for providing information to one of our preferred attorneys or law firms.

Referral fees to non-lawyers are strictly prohibited by the American Bar Association as well as the State Bar of California.

Mediation Preparation

Mediation Preparation

Many local courts require parties to a custody case matter to participate in a Mediation Appointment aka Child Custody Recommending Counseling, which can be intimidating and critical. Should it be decided by the supervising attorney, we can schedule an appointment to discuss what to expect and how to properly plan and organize your thoughts and concerns so that you can present your issues and concerns effectively and concisely.

Things to Consider

Attorney Representation

Mediation Preparation

For Individuals who find themselves in a custody dispute, or for attorneys who already have a client with a custody dispute, we generally encourage that the parent should consider voluntary participation in a Parent Education Program, Co-Parenting Program, and First Aid/CPR Certification.

While it may seem unnecessary unless ordered by the Court, many families find benefit from completing these courses. Doing so before being ordered by the Court can help eliminate potential arguments being brought against you in court.

Referral information for such programs can be found on local court websites.

Developing Parenting Plans

What Is ‘Physical Custody’?

Developing Parenting Plans

A parenting plan is an outline of legal and physical custody, as well as any visitation schedules, for your children. It is always best to be as specific as possible. One should also consider "midweek parenting time" "weekend parenting time" "holiday and special day schedule," custodial exchange desire (place, time, and who) will be participating or be present) Some individuals request court orders for Counseling, Parenting Education, Drug Testing, Alcohol Assessments, Psychological Evaluations, and more if relevant to their factual situation.

What Is ‘Physical Custody’?

Developing Parenting Plans

Courts have stated that "Legal custody" refers to who will be allowed to make legal decisions on matters related to your children, including but not limited to education, participation in extra-curricular activities, medical care, dental care, and mental health services. In California, the courts presume that legal custody should be shared between both parents but there are several exceptions to this presumption where the court may grant sole legal custody to one parent.  (This is not to be interpreted as legal advice, and only generalized public knowledge and information)

Online Parental Communications Programs

Courts have stated, that "Physical custody" refers to which parent your children live with and when. Joint physical custody means the parents are sharing time with the children. The children spend time at each parent’s house, including overnight stays, according to a schedule that is best for the children. Joint physical custody does not necessarily mean the children are spending exactly half of their time with each parent (often referred to as 50/50 physical custody).  (This is not to be interpreted as legal advice, and only generalized public knowledge and information)

Online Parental Communications Programs

For individuals who are experiencing difficulties in communicating with the "other parent" or for attorneys who have clients regarding this particular issue, local courts have found great success in increasing communications between parents by implementing an Online Parental Communication Program to be utilized.

A few of those programs are listed here:

Privacy Policy

An attorney privacy policy outlines how a law firm or individual attorney collects, uses, and protects the personal information of clients and other individuals. It's a crucial document that ensures compliance with relevant privacy laws and builds trust with clients.

Here's a more detailed breakdown of what a typical attorney privacy policy includes:

1. Information Collection and Use:

What information is collected:

This section specifies the types of personal data the attorney or firm collects, such as name, contact information, financial information, and any other relevant details.

How information is used:

The policy clearly states how the collected information will be used, including for case management, communication, billing, and compliance with legal obligations.

Data security measures:

The policy outlines the steps taken to protect client data, such as physical, electronic, and procedural safeguards, to prevent unauthorized access or disclosure. Our office utilizes an Online Case Management Platform via www.MyCase.com.

MyCase implements the same standard of 128-bit SSL encryption used by banks to provide law firms with a secure connection to send and receive data. All stored information is then encrypted with 256-bit AES encryption to add an extra layer of security.

Data retention:

(Retention Periods)

Most client files should be retained for at least five years, but some may require longer retention due to factors like the nature of the case, the client's status (minor, etc.), or legal requirements.

(Client Consent:)

Original documents and items of intrinsic value given to the lawyer by the client must be retained unless returned to the client or with their consent for destruction.

(Notification and Response)

Before destroying other client materials, the lawyer must reasonably notify the client and give them a reasonable time to respond. It is  customer/client's duty to keep our office informed of any updates to their contact information including phone numbers, mailing addresses, and regularly monitored email account address information.

(Destruction Methods)

The policy should specify how client files will be destroyed, including shredding and digital deletion..

(Storage)

The policy should outline where client files will be stored (on-site, off-site, in electronic form, etc.) and the security measures in place to protect client confidentiality.

(Recordkeeping)

A record of destroyed files should be maintained to ensure accountability and transparency.

2. Disclosure to Third Parties:

Limited disclosures:

The policy states that personal information will not be disclosed to third parties without consent or unless required by law or professional rules.

Exceptions:

Exceptions to the Third Party Disclosure such as disclosures to agents acting on behalf of the firm, regulatory authorities, or as necessary to provide services.

Compliance with laws:

The policy clarifies that all disclosures will be made in accordance with applicable laws and regulations.

3. Client Rights:

Right to access:

Clients may have the right to request access to their personal information held by the attorney or firm.

Right to rectification:

Clients may have the right to request that inaccurate or incomplete information be corrected.

Right to erasure:

Clients may have the right to request the deletion of their personal information, subject to certain exceptions.

4. Compliance with Legal and Regulatory Requirements:

Applicable laws:

The policy acknowledges compliance with relevant data privacy laws and regulations, such as the California Consumer Privacy Act (CCPA).

Professional conduct:

The policy emphasizes adherence to the Rules of Professional Conduct applicable to attorneys.

5. Policy Updates:

Notification of changes:

The policy may state how clients will be notified of any changes to the privacy policy.

Website or email communication:

Changes may be communicated via the firm's website or through email to registered clients.
